Workplace injuries can be difficult to diagnose. The following video transcript explains the different between workman's compensation and personal injury claim.
“Some people want to know if they have a work comp injury is that exclusive to personal injury; not all of the time. In California you can’t sue your employer if he has workman’s compensation insurance. If he doesn’t, let us k now we can answer those questions. But if you’re working and you’re injured while you’re on the job but you’re injured by another person that isn’t your employer. If a wall falls down on you and your employer doesn’t own the premises if a driver crashes into and he doesn’t work for your employer you can also pursue a personal injury cause of action. One of the main differences under work comp, they don’t pay you for your pain and suffering, under personal injury they do pay you for your pain and suffering.
