“My name is Lee Arter. I’m an attorney license to practice in the state of California and the federal bench. I’ve had my own firm for the last twenty years. Before that I went to work for another law firm in and I went to work in their litigation department, which meant I had to try cases. I had to get cases where there was something wrong with it, straighten it out, do discovery, do all the things that prove up the case.
So when I started my own firm 20 years ago, the main office is located on Wilshire. We have offices in Fresno, in San Diego, in Riverside. But when we started out office we got in the habit of filing lawsuits. If they wouldn't’t offer us enough money we’d file the lawsuit. We have no qualms about it, we are comfortable with lawsuits. If you check with the insurance companies in our rating they know we are one of the attorneys that file lawsuits. We know how to bring it in, how to get the doctor’s reports. How to make sure someone sees a doctor, and just doesn’t get chiropractic treatment and then says ‘well gee, my pain never went away.’ Know how to see an orthopedic surgeon or a neurologist or if they have a head injury, discovering if there is a head injury or if it’s a mild head injury.

The way we handle our other cases and a lot of them never get to litigation, is the same way with the idea that if we have to we know what elements it is to get to take it to trial. And the insurance companies know that to, they know the attorneys that do the work and get the information. They know the law firms that can take it to trial and those are the ones that they will pay the good money for. Because they know that if they do not settle it now they will put it in front of a jury and they are afraid of what the jurors will do. Jurors can swing one way or the other and to get the fairest and most value for your money you have to take the steps, know what you’re doing in discovery, know how to file a lawsuit, know how to take depositions, know how to ask the right questions to get all the information so the insurance company will say ‘you know what they got us.’ Because they do not give information easily and if you don’t get the right information they will notice that and they will base their offer depending on that.”
