Negligence, which is defined as acting in a way which is below the standard of care generally accepted for that particular activity. Additionally, while proving your case, you must show that the negligent person acted in a negligent way based upon that person's:
- knowledge;
- experience; and
- background.
Therefore, attorneys would have a higher standard of care when acting on behalf of their clients, doctors will have a greater standard of care when working with and treating patients, and a certified public accountant would have to provide a higher standard of care when creating financial data. However, they are only held to that higher standard of care when they are working in their particular field. Therefore, an attorney would be held at a lower standard in applying first aid to someone than a doctor would, because it is the doctor's specialty.
