Discovery Rule

• Statute of Limitations ("SOL") begins to run from actual date of the injury, or from the date when the injury should have been discovered.

Personal Injury cases in Los Angeles

• 2 years with discovery rule.*

Wrongful Death

• 1 year*

* Exceptions: Death from exposure to asbestos or medical malpractice. 

Medical Malpractice

• Generally, the earlier of:*
  • 3 years from date of injury; or
  • 1 year from date of discovery

* Exceptions: Statute of Limitations for foreign objects runs from when object is, or should have been, discovered.

• Infants under 6
  • 3 years from date of injury, or prior to age 8*

Exception: May be tolled by fraud or collusion of parent or guardian.

• Intentional concealment or fraud regarding non-therapeutic foreign object in person
  • 3 years California statute of limitations.

Elder Abuse

• 2 Year Statute of Limitations.

Malpractice (Other Professions)

• 1 year SOL.

Products Liability

• 2 years with discovery rule.

Intentional Torts

• Either 1 or 2 years.

Fraud

• 3 years from actual discovery of fraud or mistake.

Municipal Liability / Sovereign Immunity

• 6 months from date of notice of claim is served on entity
  • Sovereign immunity doctrine abolished.
